1. Introduction

These Terms & Conditions (“T&Cs”) govern your purchase of Mystery Box products from Elysia Mystery Box (sole trader, Unit 18, 63–65 Woodside Road, Amersham, Buckinghamshire HP6 6AA, United Kingdom; “we”, “us”, “our”). We are not VAT-registered. By placing an order, you confirm that you accept these T&Cs in full.

2. Contract Formation

A binding contract is formed when we send you an Order Confirmation email. All orders are subject to availability and our acceptance.

3. Prices & Payment

Currencies & VAT
All prices are in GBP. We are not VAT-registered; therefore no VAT is added.
Payment methods
Major credit/debit cards, Stripe, Amazon Pay, Google Pay, Apple Pay, “Pay with link” services and Klarna.
Timing
Payment is taken immediately upon order placement.
Pricing errors
If an obvious pricing error occurs, we reserve the right to cancel your order or offer you the product at the correct price.

4. Processing & Dispatch Times

• Standard Mystery Boxes: Orders placed before 13:00 BST are dispatched the same day; all other orders by the next business day.

• Noire Edition (limited to 10 per month): Allow up to 3 business days for picking and packing, plus shipping time.

• Business day: Monday–Friday, excluding UK bank holidays.

Some editions (e.g. Noire) are strictly limited in quantity. If sold out, we will offer the next month’s edition or issue a full refund.

7. Right to Cancel, Returns and Refunds

7.1 Right to Cancel Without Reason

Under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, you have 14 days from receipt to cancel without reason.

1. Notify us at [email protected] with a clear statement or by using the model cancellation form (Annex).

2. Return the unopened, original-condition Mystery Box to:

   within 14 days of receipt.

3. You bear the direct cost of returning the product(s).

4. We will refund the product price plus the least expensive standard delivery cost within 14 days of receiving the goods (or proof of return), via your original payment method unless otherwise agreed.

Note: If you open the box beyond what is necessary to inspect the contents, we may deduct for any loss in value. In some cases, opening the box may void your cancellation right unless essential to identify a fault.

7.2 Faulty, Damaged or Misdescribed Goods

Under the Consumer Rights Act 2015, you may request repair, replacement or refund if goods are faulty, damaged, misdescribed or not of satisfactory quality.

• Notify us within 30 days of receipt at [email protected], including your order number, a description of the fault and photographic evidence if possible.

• For faulty goods, we cover return costs or arrange a cost-free solution.

7.3 Environmental Note on Packaging

We aim to reduce packaging waste: unless you request otherwise, items are packed without extra boxes or fillers where safe. This does not affect your return rights.

8. Liability and Warranty

• Products are sold new and in original manufacturer’s condition, compliant with contract, of satisfactory quality and fit for purpose (Consumer Rights Act 2015).

• Any manufacturer’s warranty is in addition to your statutory rights.

• Our liability is limited to the purchase price paid for direct losses; we exclude indirect or consequential losses except where prohibited by law.

• We do not limit liability for death or personal injury caused by our negligence, fraud or other liabilities that English law does not allow us to exclude.

9. Age Restrictions

General boxes suit all ages. Adult-only (18+) boxes will be clearly marked; purchasers must be 18 or over.

10. Intellectual Property

All website content—text, graphics, logos, images, audio/video clips, database compilations, site design and software—is the intellectual property of Elysia Mystery Box or used under licence. No part may be copied, reproduced, distributed, republished, downloaded, displayed, posted or transmitted without prior written permission.

11. Customer Obligations

You agree to:

• Provide accurate order information (name, address, payment details).

• Use the website and products lawfully and as intended.

• Not engage in fraudulent or unlawful activity.

12. Our Rights

We reserve the right to:

• Refuse or cancel orders for justified reasons (e.g. suspected fraud, breach of T&Cs, pricing errors).

• Modify products, prices or services without prior notice for future orders.

• Amend these T&Cs; the version in force at the time you place your order applies. We will post updates on our website.

13. Mystery Box Content & Value

Contents are a surprise and at our discretion. We aim to guide you with a theme description and, where possible, a guaranteed minimum RRP.

14. Force Majeure

We are not liable for failure or delay caused by events beyond our reasonable control (e.g. acts of God, strikes, war, pandemics, postal disruptions).

15. Severability

If any provision of these T&Cs is invalid or unenforceable, the remaining provisions remain in full force.

16. Entire Agreement

These T&Cs and any documents expressly referred to (e.g. Privacy Policy, Order Confirmation) constitute the entire agreement and supersede all prior arrangements.

17. No Waiver

Failure or delay in enforcing any right does not waive that right for the future.

18. Complaints Handling & Alternative Dispute Resolution

• If unresolved, you may use an approved Alternative Dispute Resolution (ADR) body—see Trading Standards for details.

19. Governing Law & Jurisdiction

These T&Cs are governed by the laws of England and Wales. Disputes fall under the exclusive jurisdiction of the English courts.
